These Terms and Conditions ("Terms") govern your use of our website, services, and the booking of any tour packages, treks, or remote workstations ("Services") provided by Bhatko ("we," "us," or "our"). By accessing our website or using our Services, you agree to be bound by these Terms.

1. Booking and Payment Policy

1.1. Booking Confirmation:

All bookings are subject to availability. Your booking is considered confirmed only after we receive the specified advance payment and you receive a booking confirmation email from us.

1.2. Payment:

• An advance payment (typically 50% of the total package cost, unless specified otherwise) is required to confirm your booking.
• The remaining balance must be paid before the start date of the tour/trek, as specified in your booking confirmation.
• Failure to pay the balance on time may result in the cancellation of your booking.
• Payments can be made through the methods specified on our website.

2. Cancellation and Refund Policy

2.1. Cancellation by You:

If you wish to cancel your booking, you must notify us in writing via email. The following cancellation charges will apply:

• 30 days or more before departure: 25% of the total booking cost.
• 15-29 days before departure: 50% of the total booking cost.
• Less than 15 days before departure: 100% of the total booking cost (no refund).

2.2. Cancellation by Us:

In the rare event that we need to cancel a trip due to unforeseen circumstances (e.g., natural disasters, political instability, insufficient bookings), we will offer you the choice of:

• A full refund of all amounts paid.
• An alternative trip of a similar standard. If the alternative trip is of a lower value, we will refund the difference.

2.3. No-Show:

If you fail to show up for the trip, no refund will be provided.

3. User Responsibilities and Conduct

3.1. Health and Fitness:

• You are responsible for ensuring that you are physically and medically fit to participate in the booked activities, especially for treks and adventurous tours.
• You must inform us of any pre-existing medical conditions at the time of booking. We reserve the right to refuse a booking on medical grounds if we believe it could compromise your safety or the safety of our group.

3.2. Conduct:

• You are expected to behave in a manner that is respectful to other participants, our staff, and local communities.
• Illegal activities, including the use of prohibited substances, are strictly forbidden.
• We reserve the right to remove any participant from a trip if their behavior is deemed unsafe or disruptive, with no refund provided.

3.3. Travel Documents:

You are responsible for ensuring you have all necessary travel documents, such as a valid ID, permits (if required), and visas (if applicable).

4. Risks and Liability

4.1. Assumption of Risk:

By booking a trip with us, especially a trek or adventure tour, you acknowledge that these activities involve inherent risks, including but not limited to, physical exertion, altitude sickness, accidents, and exposure to extreme weather conditions. You assume all such risks.

4.2. Limitation of Liability:

Bhatko and its employees will not be liable for any injury, illness, death, loss, damage, expense, or other claim of any nature whatsoever which results from:

• The act(s) and/or omission(s) of the person(s) affected.
• The act(s) and/or omission(s) of a third party not connected with the provision of the Services.
• Force Majeure (unforeseeable or unavoidable events beyond our control).

5. Itinerary Changes

While we strive to adhere to the planned itinerary, we reserve the right to make changes due to weather conditions, road closures, or other operational reasons to ensure the safety and well-being of the group. Any additional expenses incurred due to such changes will be your responsibility.

6. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Bhatko and is protected by copyright laws. You may not reproduce, distribute, or use any content without our prior written permission.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [Your City, e.g., Shimla], Himachal Pradesh.

8. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
